Tracie Nininger has now filed an appeal with the Virginia Supreme Court. The court says the paperwork arrived today.
Jeff Dupree has appealed his manslaughter conviction to the Virginia Supreme Court, according to online court records.
Dupree and co-defendant Tracie Nininger have until the end of the day to appeal the decision of a panel of the Court of Appeals. So far, there is no Supreme Court appeal listed under Nininger's name.
The pair was convicted of manslaughter last year in the death of a highway construction worker. The crash happened in the Tanglewood area late one Winter's night two years ago. The appeals court concluded Dupree was "highly intoxicated," that he was calling Nininger on his cell phone and following her Hummer too closely when he struck her vehicle.
Nininger and Dupree both remain on bond until their appeals are exhausted.
