A confusing Radford murder case will likely drag out into a third year.     Phillip Beale, Jr. was convicted of first degree murder for shooting and killing Floyd Wright, Junior in 2009.     A sentencing hearing was scheduled for Firday, but his defense attorney tried to take up motions for a new trial based on new evidence.     However, there was a procedural error and the matter will likely be taken up again in January.     The motion states that a witness in the case was pressured into testifying against Beale Jr. and allegedly threatened with losing custody of her child.

An arrest has been made in a Martinsville murder case. Dominique Quemain Hylton has been charged with first degree murder. He's accused of killing a clerk at the BG Express in May.    Hylton and Steven O'Neal Porter are accused of running inside the gas station and killing Nirmal Singh. Another clerk was injured. Hylton was arrested and held in June for a different crime, but officials finally charged him in the murder case on Thursday.

Police want a DNA sample from a woman named, Dorniki Turner. They say Turner had information about Aveion Lewis' death only investigators knew.. If you remember, police were called to a home on King Charles Avenue in January 2010 for a report of a missing baby. Brandon Lockett claimed his two-year-old stepson was kidnapped. Within a week, police said Lockett had admitted the child was never kidnapped and was dead before 911 was ever called.

The Commonwealth was set to present its case against Morgan Lockett starting Monday, but a judge agreed to delay the case until October. According to the Virginia Judicial website, the case will now begin on October 11th.  It's set for two-weeks. Lockett's defense team has previously expressed concern about reviewing thousands of pages of written evidence. Morgan Lockett faces several charges in connection with the January 2010 death of her son, Aveion Lewis.  Investigators believe she and her husband, the child's stepfather, Brandon Lockett, were behind Aveion's death.  The child was found in a landfill nearly two-weeks after he was reported missing.

Two years ago, two Virginia Tech students were discovered shot and killed off campus in Montgomery County.  The murder case remains unsolved. This would have been Heidi Childs and David Metzler's senior year at Virginia Tech.  But the couple never made it to their sophomore year.  The two were very much in love and drove out to the Caldwell Fields area of the Jefferson National Forest the night before the start of classes at Tech in August 2009. ...

Martinsville Police have confirmed the identity of a man found dead inside his home. Police say Donald K. Lawson was killed at 806 Parkview Avenue in Martinsville. While investigating the murder, police determined that Lawson's van had been stolen. The van was found late Tuesday night in Henrico County. 41-year-old Kenneth Smith of Martinsville and 24-year-old Amanda Alexander of Martinsville have been charged with breaking and entering and grand larceny of a motor vehicle.

A Bedford County murder case will be in the national spotlight A former assistant principal convicted of killing his wife is talking in his first and only on-camera interview for CBS' 48 Hours Mystery. Wesley Earnest says he and his wife Jocelyn had a great marriage, but then the romance disappeared. On December 20th, it'll be four years since Jocelyn was found dead in her home, shot in the head with a note nearby making it look like a suicide. But a jury never bought that she killed herself.

A missing persons investigation in Virginia is now a murder case. Investigators in Wise County say a man killed his father and step-mother. Deputies found two bodies in the Duncan Gap area less than a week ago. Investigators arrested Mark Coleman. Investigators say he shot and killed Robert Coleman. They say he kidnapped Sharon Coleman and killed her later. Investigators say they're sure the bodies are the accused killer's family, but an autopsy will have to confirm that.

Bow hunting season starts tomorrow and police are hoping that will help turn up leads in the murder case of two Virginia Tech students. Heidi Childs and David Metzler were killed in August near the Caldwell Fields recreation area in the Jefferson National Forest. Police want people hunting in that area to keep an eye out for any suspicious objects that may help them get closer to finding who killed the young couple. The reward for information on the case is now up to $50,000.

It is a case that started 7-months ago when a couple in their 80s was tied up and robbed in their Botetourt County home. Police in Roanoke served a warrant on Warren Lemons yesterday. He- along with Kevin Ferguson, George Fitzgerald and Dejuan Lemons are all charged in the December incident. Police released a mugshot of Warren Lemons Tuesday. But, we first met him more than 20-years ago when he was a witness in a murder case.  Lemons was just a junior at William Fleming when his testimony fell apart on the witness stand.

Police are still looking for the person who killed an 86-year-old woman in Lynchburg last month.  In the meantime officers are trying to ease fears in the neighborhood where the murder happened. The Lynchburg Police Department is holding a seminar Thursday to talk about home security and personal safety.  There's been a lot of interest in those topics, ever since Lynda Slocum was found dead in her home on Ravenwood Drive December 20. No arrests have been made, but police are trying to reassure Slocum's neighbors and share tips that will keep them safe.  They're also trying to encourage resident to take part in neighborhood watch efforts.

Drivers entering Diamond Hill Tuesday probably had no idea they were passing by a murder scene. A grassy spot in the 1900 block of Grace Street, just feet from the Lynchburg Expressway, was the site of a deadly stabbing Monday night. "There was an argument," said Glenn Anderson, a detective with the Lynchburg Police Department.  "When officers arrived, they found a man lying in the roadway. " The man in the road was Mark Rowley, a 39-year-old who lived nearby. He was stabbed in the middle of a busy neighborhood, which meant investigators had plenty of witnesses to interview.

We learned new details Wednesday about the people arrested for seperate killings in Campbell County, and how the victims died. Late Tuesday, deputies arrested Vincent Spinner in connection with the death of his father-in-law, James C. Payne. Deputies say Payne was known for helping Spinner financially, and a money issue may have led to last Friday's killing. "Although no obvious motive is known in this matter, it is well known in the family that Mr. Payne had assisted Spinner financially in the past," said Major L.T. Guthrie with the Campbell County Sheriff's Office.

A Martinsville man facing charges for a Roanoke murder has been acquitted. 42-year-old Terry Preston was on trial for the death of 19-year-old Patrick Dennis. Dennis was found shot to death in October. A jury in the City of Roanoke on Thursday morning found Preston not guilty of murder and the use of a firearm in commission of a murder. Henry County sheriff's investigators have made an arrest in a case that has murder written all over it. Authorities picked up Patrick Gilbert Tuesday, charging him with first-degree murder.  They believe Gilbert shot and killed 26-year-old Jason Miller. You may recall the victim's body turned up a week ago in a shallow grave on Pen Rose Lane.  That's after he'd been missing for almost a month. Authorities are still searching for Cory Thomas who police say may also be tied to the homicide.  Warrants for him also include first-degree murder and robbery.

A Roanoke County man charged with capital murder in the beating death of a woman has been ruled competent to stand trial, officials said Wednesday. Carey Shane Padgett had been ruled incompetent because his depression prevented him from aiding in his own defense. During a motions hearing in Roanoke County Circuit Court Wednesday in Salem, several issues were raised relating to a possible trial, set for late October. The jury selection process and funds to pay for an expert witness were all brought before a judge, although not ruled on. Padgett is facing charges for the murder of Cara Holley in July 2010.
